Introduction and Pre-contractual Information

Welcome to Kaleidostory! Below you will find the terms and conditions for the use of the website www.kaleidostory.com (hereinafter also referred to as the “Website” or “Kaleidostory”).

Kaleidostory is a web platform aimed at conveying, in a simplified manner, current and multidisciplinary topics, such as art and culture, family and society, environment, technology, etc. through articles, interviews and videos, as well as promoting events and fundraising campaigns.

The Website is owned by Consorzio Campus Bio-Medico S.c.r.l., headquartered at Via Alvaro del Portillo, n. 21, 00128, Rome (RM), Tax Code and VAT number 17193741000 (hereinafter referred to as the “Consorzio”).

Accessing and browsing the pages of the Website implies acceptance by the user who navigates and interacts with the Website (hereinafter referred to as the “User”) of the conditions specified herein (hereinafter, the “Terms of Use”).

If the User does not intend to accept these Terms of Use, they must refrain from browsing and using the Website and consequently leave it.

The Consorzio reserves the right to update or modify these Terms of Use at any time – providing prior notice to the User – which will be considered binding from the moment of their online publication.

The date of the last update of the Terms of Use is indicated at the bottom of this document.

Use of the Website

The use of the Website by the User is completely free; however, some features on Kaleidostory are reserved for Users who register on the Website.

The use of the Website in any case implies compliance with these Terms of Use and the applicable law. Any misuse will be penalized at the appropriate venues and according to the most appropriate procedures. By way of example and not exhaustive, the User, by using the Website, undertakes to:

  • Not to interfere with the activities of the Consorzio.
  • Not to damage or tamper, in whole or in part, with the Website, nor with any network, equipment, or infrastructure used for the development, use, management, hosting, release, and more generally for the operation of the Website.
  • To have only one account.
  • To provide exclusively truthful information and/or statements.

Failure to comply with the Terms of Use of the Website constitutes a serious breach and may result in the Consorzio resorting to one or more measures, including, by way of example and not exhaustive:

  • Immediate temporary suspension or permanent deletion of the User's account.
  • Issuance of a warning to the User.
  • Legal action against the User, including the request for reimbursement of all costs arising from one or more violations.

The Consorzio may take any other action it deems reasonably appropriate to protect its interests at any time.

Registration on the Website

Registration on the Website is completely free and takes place by filling out a dedicated registration form in which the User must necessarily indicate: first name, last name, and email address; the User may choose whether or not to provide their phone number, date of birth, gender, profession, country, city, and region where they live, without the failure to provide such information constituting an impediment to the user's registration on the platform.

During the filling out of the registration form, the User must also create a password and confirm it; the password must contain at least 8 characters, at least 1 uppercase letter, 1 special character, and 1 number.

Once the registration form is completed, the User must choose their preferred topics among those covered by Kaleidostory (e.g. family and society, education and work, art and culture) and, after having read and accepted these Terms of Use and the personal data processing policy, they can finalize the registration to Kaleidostory and the creation of their personal account.

Before confirming the registration on the Website, the User may also decide whether or not to subscribe to the Kaleidostory newsletter by checking the appropriate consent box; if the User decides not to subscribe to the Kaleidostory newsletter, they can still register on the Website. The User may cancel the newsletter subscription at any time directly from their personal profile, or via the appropriate unsubscribe link in the footer of the newsletter.

Following the registration on the Website and the subscription to the Kaleidostory newsletter, the Consorzio will send the User an email to confirm the registration to Kaleidostory, as well as an email to confirm the subscription to the Kaleidostory newsletter.

The User is aware that the username and password for accessing their personal account must be kept secure, kept secret, and in any case used in a manner that prevents third parties from accessing their account.

The Consorzio is not responsible in any way for any access made by persons other than the account holder without their consent.

In the event of theft and/or loss and/or unauthorized disclosure of the access credentials to the personal account, the User must immediately inform the Consorzio by sending an email to info@sccbm.it. At the same time, the User must proceed to reset the credentials using the procedure available on the Website. In any case, the personal account may be deleted by the User at any time through the appropriate function available in the personal profile.

Once the registration is confirmed, the user will be able to access the features of the Website reserved for registered Users.

By registering on the Website, the user:

  • guarantees the truthfulness and completeness of all the information provided during registration;
  • is required to keep the data updated and to proceed with their modification in case of changes, even if only partial.

The Consorzio is not responsible for the truthfulness of the information and data entered by the User on the Website.

The Consorzio reserves the right in any case to suspend access to the account and/or permanently close it if it deems that the account is being used by the User in a manner contrary to these Terms of Use and/or to legal provisions.

The Consorzio also reserves the right to suspend and/or permanently close those accounts that it deems inactive, or if it finds the existence of multiple accounts registered to and/or attributable to the same User. In the latter case, before proceeding with the suspension and/or permanent closure of the account, the Consorzio will send a specific email notification to the address associated with the account, at least 30 days in advance. In case of no response within the period indicated in the aforementioned notification, the account will be permanently deleted.

What You Can Do on the Website

Kaleidostory is a web platform aimed at conveying, in a simplified manner, current and multidisciplinary topics, such as art and culture, family and society, environment, technology, etc. through articles, interviews, and videos, as well as promoting events and fundraising campaigns. By browsing Kaleidostory, the User will be able to view the contents available on the Website (articles, interviews, and videos).

Access to the Website is completely free; however, some features are reserved for registered Users. Registration on the Website is completely free (see art. 3).

By registering on the Website and accessing their personal account, the User will be able to save certain contents to their profile, modify the information provided during registration, reset the password, change their interests, customize the newsletter by indicating the topics they prefer among those covered by Kaleidostory, view saved stories, reset preferences, delete the account, log out, consult the FAQs, and leave feedback.

It is understood that the Website does not engage in any profiling activity of the User; in fact, it is the User themselves who, by accessing their personal profile, can autonomously indicate the topics they prefer among those covered by Kaleidostory and modify them at any time.

Limitations of Liability

Except in cases of willful misconduct or gross negligence attributable exclusively to the Consorzio, the latter is not liable towards Users and/or third parties, neither contractually nor extracontractually, or by any other title or reason, for any damages, even indirect, that may result from the use of the Website.

In particular, the Consorzio will not be liable for:

  • any loss of profits, sales, business, or income;
  • loss of commercial opportunities;
  • loss of goodwill;
  • any indirect or consequential loss.

The Consorzio reserves the right to make changes to the features of the Website or to its operation at any time and without notice.

The Website may contain hyperlinks to websites owned by third parties. The Consorzio cannot, in any way, be held responsible for the content of these websites, nor for any damages suffered as a result of the User's use of these websites outside the control of the Consorzio.

By using such links, the User understands that the legal notices and privacy policies of the linked sites will apply, and these may be different from those of the Consorzio.

Intellectual Property Rights

All intellectual property rights related to the Website, as well as all materials published on it, belong to the Consorzio or have been licensed to it.

Such works are protected by the applicable national and international copyright and intellectual property laws.

The User is prohibited from copying, reproducing, downloading, publishing online, distributing, transmitting, making available to the public or otherwise using any content present on the Website, by any means, for commercial purposes.

Processing of Personal Data

The Consorzio is particularly attentive to compliance with the laws regarding the protection of personal data. For this reason, we inform you that every personal data is collected in full compliance with Regulation (EU) No. 2016/679 (the so-called GDPR) and the applicable privacy laws.

Miscellaneous

Should one or more provisions of these Terms of Use be declared invalid, null, or ineffective, in whole or in part, such invalidity, nullity, or ineffectiveness will concern only those provisions. The remaining clauses will therefore remain valid and effective to the fullest extent permitted by law.

These Terms of Use and any other document explicitly referred to therein, including the personal data processing policy, constitute the entire agreement between the Consorzio and the User. They replace all previous understandings, agreements, negotiations, contracts, minutes, and/or written communications that may have taken place between the Consorzio and the User.

Any failure or delay in the implementation (in whole or in part) of any provision of these Terms of Use cannot be interpreted as a waiver by either party to enforce their rights or remedies.

The Consorzio may assign any right or obligation provided for in these Terms of Use to an affiliated company or to any company with which it associates to conduct its business, that it acquires or to which it is sold, even in the case of a transfer of business or business unit, provided that the protection of the rights of Users, whether consumers or not, is not diminished as a result of the transfer.

Governing Law and Jurisdiction

Any claims and/or disputes that may arise in relation to the interpretation and/or execution of these Terms of Use will be governed and interpreted in accordance with Italian law. For consumers residing in Italy, the mandatory Italian consumer protection law (Legislative Decree 206/2005, also known as the Consumer Code) will apply.

For Users who do not fall under the definition of “consumer” according to Italian law, the resolution of any claims and/or disputes arising in relation to the interpretation and/or execution of these Terms of Use will be subject to the exclusive jurisdiction of the Court of Milan.

For Users who fall under the definition of “consumer” according to Italian law, instead, the resolution of any claims and/or disputes arising in relation to the interpretation and/or execution of these Terms of Use will be subject to the exclusive jurisdiction of the consumer's place of residence or domicile.

Alternatively, the consumer may submit their claim to the Online Dispute Resolution Platform for out-of-court dispute resolution (European ODR Platform) (Art. 14, para. 1 of EU Regulation 524/2013).
